On 29th March 2017, The United Kingdom submitted notification of its intention to withdraw from the European Union. All European Union primary and secondary law will cease to apply to the United Kingdom on 12th April 2019. Preparing for the United Kingdom’s withdrawal is not just a matter for politicians, but also for private enterprise – especially where CE marking for market access to the European Union is concerned. In the absence of a comprehensive transition agreement or trade deal between the European Union and the United Kingdom there is risk of significant disruption to manufacturers who place products on the European Market.

In some product areas, ATEX marking requires the involvement of a third party, known as a Notified Body. European legislation requires that Notified Bodies are established and designated by Member State designating authority. This means that, in the absence of a transition arrangement or trade deal UK Notified Bodies will lose their status on the withdrawal date. In this scenario, manufacturers with products certified by UK Notified Bodies will no longer be able to place those products on the European Market from 30th March 2019 and will need to apply for a certificate issued by a Notified Body in the remaining 27 EU Member States. In the event of failure to reach a transition agreement or trade deal, which includes conformity assessment, manufacturers with CE certificates issued by United Kingdom Notified Bodies will need to either apply for a new CE certificate or arrange a transfer of certification in advance with a Notified Body from the remaining 27 EU states. In complex and high-risk product categories, for example Hazardous Area Equipment (ATEX) or Medical Devices, conformity assessment can take a significant length of time, especially if testing is required.
